Neonode – 993 dead and buried!

Shortly after the hearing, the three judges came out with a decision for 993. Three working days later! That’s quick.
The decision was to Affirm the IPR boards decision, that the 993 patent is invalid.

Hence, Neonode’s appeal failed.

It is permissible to petition the Supreme Court, though they rarely hear patent cases, and only when those cases concern substantial matters of patent law with widespread ramifications. This particular case will not meet such criteria.

This could indicate that the other two IPR cases also comes fast (and Affirmed). Then they (likely) take more time on the 879 DC case which is more complicated.

BUT

They are not out yet (3 days later). So it could also mean that they will come in batch, since they all relate to the same patent. And are dependant of each other for the outcome.
Should they Affirm the IPR board decisions for 879, which is likely, everything hangs on the “Markman appeal”.
Should they reverse any of the IPR decisions, the others doesn’t matter.

This is when you start speculate; What does this mean? In which order will the last three be announced?
Can you read anything into this (delay)?

If I may speculate a bit….. (speculate is the word, = guessing). I think the two IPRs will be Affirmed, hence have no impact on the results since it then depends on the Markman appeal.
I also think that these three decisions will come in batch. I don’t see why they would be released one by one… !?

What do you think?
